Supreme Court Rejects RIAA Appeal To Subpoena ISPs
From the Wall Street Journal: "With the Supreme Court's rejection of its appeal, the recording industry Tuesday suffered a setback in its bid to force Internet service providers to turn over the names of possible music copyright violators.
"The high court rejected the appeal from the Recording Industry Association of America Inc. without comment. The decision let stand a lower court ruling that rejected a streamlined subpoena process the recording industry was using to try and access customer information at Internet service providers.
"The 1998 Digital Millennium Copyright Act, among other things, gave copyright holders new tools to try and stop technologically advanced pirating of music, films and other copyrighted material. At issue in this case is whether a subpoena attached to no other legal proceedings can be used to hunt down information about suspected copyright violators...
"In a case testing the subpoena provision, the industry locked horns with the Internet unit of Verizon Communications. Verizon has fought the industry's efforts to gain access to customer data without first filing a lawsuit...
"The Supreme Court's decision to leave the lower court ruling untouched could impact other pending copyright litigation efforts by the music industry."
